ELIGIBILITY: The MVP Contest (“Contest”) is open to registered members of the Scientist Solutions Bulletin Board (“Bulletin Board”) who are age 18 or older, and who possess a degree in a science or in engineering and who work within the field of life sciences. Employees, officers and directors of BioTech Solutions, Inc. (“Sponsor”), its advertising agencies and suppliers of web site services, and the judges for this Contest, and each of their immediate family members and members of the same household (whether or not related), are not eligible to participate. By participating you agree to be bound by these Official Rules. Void where prohibited.
CONTEST PERIOD: The Contest runs on a monthly basis until the Sponsor announces the Contest will be discontinued. The Contest begins each month at 12:00:01 a.m. (PT) on the first day of each month and ends at 11:59:59 p.m. (PT) on the last day of the month.
TO ENTER: If not already a registered member of the Bulletin Board, you must register at www.scientistsolutions.com (“Web Site”) to enter. There is no fee to register, use the Bulletin Board or enter the Contest. You enter by making posts (new threads or replies). Each post you make to the Bulletin Board will be reviewed by Scientist Solutions' team of scientific moderators. All posts become the property of the Sponsor. Sponsor reserves the right to disqualify any participant that is abusing the entry process, making inappropriate posts or replies or is otherwise violating any Web Site or Bulletin Board terms of use or rules.
SELECTION OF WINNERS: Scientist Solutions' team of full time scientific moderators will choose a Most Valuable Professional (“MVP”) based on the content or usefulness of a member’s posts during a particular month, as determined in their sole discretion. One member will be selected as MVP from the entire Bulletin Board each month, promptly after the end of each month. Winners will be notified by e-mail or regular mail promptly after the drawing. Winner must respond within 10 days after notification or an alternate winner will be selected. Winners will be required to complete, sign and return an Affidavit of Eligibility and Liability Release and, where lawful, a Publicity Release, no later than 10 days after the date winner responds to the notice that he or she is the winner. If documents are not returned timely, or if a prize notification or prize is returned as non-deliverable, or if a winner is found to be ineligible or otherwise not in compliance with these Official Rules, the applicable prize will be forfeited and an alternate winner selected.
PRIZES: Winner will have his or her choice of an iPod®. Approximate Retail Value: $159-$249, depending on the model selected. Winners also automatically become Frog Laureates! Prizes provided “as-is.” Prizes will be delivered to winner at Sponsor’s expense. Optional equipment, extended warranty coverage, insurance and taxes are not included in the prize and are the sole responsibility of the winner. No transfer, cash redemption, or substitution of prize permitted, except Sponsor may substitute cash or prize of equal or greater value if stated prize becomes unavailable or for any other reason in its sole discretion. All prizes will be awarded.
GENERAL CONDITIONS: You agree (a) that Sponsor, its respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents are released from, will have no liability whatsoever for, and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to person(s), including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Contest or any Contest-related activities and (b) except where legally prohibited, winners grant permission to Sponsor and those acting under Sponsor’s authority the right to the use of his/her name, picture, likeness, voice, biographical information and statements, at any time or times, for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval. Information provided during registration is subject to the Privacy Policy available on the Web Site.
LIABILITY LIMITATIONS AND DISCLAIMERS: Neither Sponsor nor its agencies are responsible for lost, late, misdirected, incomplete, non-delivered entries or email; or for interrupted or unavailable satellite, network, server, Internet Service Provider (“ISP”), Web Site, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Persons who tamper with or abuse any aspect of this Contest, as solely determined by the Sponsors, will be disqualified. Neither Sponsor nor its respective agencies are responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the Web Site. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest, and select the winners from entries received prior to action taken or as otherwise deemed fair and appropriate by the Sponsors. Neither Sponsor nor its respective agencies are responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest, and assume no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction, or unauthorized access to or use of this Web Site. Sponsor provides no warranty with respect to the prizes. Any warranty for a prize shall be as provided by the manufacturer of the prize.
IN NO EVENT WILL SPONSOR, ITS AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR RESPECTIVE ADVERTISING OR CONTEST AGENCIES OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEB SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE WEB SITE. GOVERNING LAW & DISPUTES: All matters relating to the Contest shall be governed by these Official Rules and California law. Sponsor’s decisions are final and binding in all matters related to this Contest. Any disputes will be resolved exclusively by arbitration administered by JAMS pursuant to its Streamlined Arbitration Rules and Procedures, with such arbitration to be held in San Diego, California. By participating in the Contest you consent to arbitration in San Diego, California, as the sole and exclusive forum and venue for resolving any disputes arising under these Official Rules or in connection with the Contest and waive all rights, if any, to a trial by jury. If the foregoing arbitration provision is deemed to be unenforceable for any reason, you consent to the exclusive jurisdiction and venue of the state or federal courts located in San Diego County, California.
WINNERS LIST: For a written confirmation of the prize winner's name, city and state of residence send a self-addressed, stamped business size envelope, for receipt not later than 30 days after the applicable month to: BioTech Solutions, Inc., 2628 West Canyon Ave., San Diego, CA 92123 Attn: Winners List. The User ID’s of winners will also be posted on the Web Site.
Be sure not to refer to the MVP Contest as “the iPod contest” or “the iPod giveaway” or anything else similar. It is ok to use the term “iPod” in a very limited sense, principally when describing the prize being awarded. The more times you use “iPod,” the more likely it could be deemed to be trademark infringement or an unfair trade practice.
