Senior Legal Director and Corporate Officer - Brazil @ Monsanto company
Monsanto do Brasil is seeking a highly experienced, team-oriented attorney to lead its Brazilian legal department as the Director of Legal Affairs, based in Monsanto's Sao Paulo office. As a member of the Brazilian leadership team, and as a Corporate Officer of Monsanto's Brazilian subsidiaries, this professional will act as a key partner in guiding all aspects of Monsanto's Brazilian businesses.
Key areas of responsibilities:
· Develop and lead the Brazil legal team, including mentorship of legal talent and recruitment of additional attorneys and staff
· Counsel clients across multiple functions, including commercial (marketing, sales, product management, licensing), finance, strategy, corporate governance/FCPA, human resources/employment, government and industry affairs, regulatory affairs, manufacturing, licensing, IT, Technology (including Research and Development located in Brazil) in all substantive legal areas
· Ensure Monsanto and its employees are in compliance with all laws and regulations, in coordination with the business leadership
· Support the successful launch of multiple new biotech and chemistry products in Brazil
· Work closely with internal and external counsel to manage complex commercial, IP (including enforcement), employment, antitrust, and tax litigation matters
· Negotiate and draft a broad range of complex commercial transactions, including supply and distribution agreements, M&A, joint ventures, research and development agreements, and commercial licensing, including licensing of intellectual property
· Proactively advocate Monsanto's position with key government, industry, and legal stakeholders in Brazil, particularly in matters involving protection and enforcement of intellectual property rights
· Define and implement creative legal solutions to sustain existing businesses and drive new commercial strategies in Brazil
· Work closely with regional and global law leadership to assure coordination, teamwork and interconnectedness across all legal functions
· Travel throughout Brazil to develop understanding of Monsanto businesses and legal needs
· Develop and implement policies and training to ensure compliance with all legal requirements, including FCPA, competition, and employment laws
Job Requirements top
· Law Degree and a current license to practice law in Brazil
· Minimum of 15 years of relevant legal experience, including at least 5-7 years of corporate experience with direct people-management responsibilities. Prior experience functioning at a Director level within a corporation, and a general working knowledge of biotechnology and/or agriculture are desired
· Significant legal experience across a broad range of substantive areas of law, including complex business transactions, intellectual property, corporate governance, employment law, tax, antitrust/competition law, regulatory, litigation, and FCPA compliance. Familiarity with intellectual property litigation, enforcement, and licensing is desired
· A record of professional growth and success, as demonstrated through outstanding legal performance, strategic and creative thinking, leadership, results-orientation, good judgment, business acumen, client focus, creativity, excellent communication skills, and strong team management and inter-personal skills
· Fluency in Portuguese and English is required (Spanish is a plus)
· Experience developing and managing strong client relationships across diverse cultures. Professional experience internationally is a plus
· Excellent team player with the ability to work and communicate with a large number of diverse people, including senior management, in a high-pressured business environment, with a flexible, open, collaborative and results-oriented attitude.
