You must make a minimum of 10 posts during the Promotion Period in order to qualify to win.

When you first register, you must choose a ‘default’ car for your entries.   At any time during the Promotion Period, you may allocate your entries among the car by going into my account and edit preferences.  The edit preferences tool also allows you to rearrange your entries at any time; provided, however, that once a car has been awarded, any entries allocated to that car will no longer be eligible to win.

Sponsor reserves the right to offer additional methods of entry or to change the number of entries received for each of the above activities from time to time during the Promotion Period.  Any changes to the methods of entry or number of entries to be received will be prominently disclosed on the Promotion page of the Web Site.

All entries become the property of the Sponsor.  Any use of robotic, automatic, macro, programmed or like entry methods will disqualify all entries by such methods.  Sponsor reserves the right to disqualify any participant that is abusing the entry process, making inappropriate posts or replies or is otherwise violating any Web Site or Bulletin Board terms of use or rules.

DRAWING:  A drawing will be held promptly after each 50,000 entries  (A Toyota Prius  was the first car giveaway) have been received provided that all drawings will be completed by June 30, 2008.  When the 100,000 and 150,000 entry milestones have been reached, notice will be given and the acceptance of entries will be suspended pending selection and confirmation of a winner.  Each entry will be valid only for the car selected, and once a winning entry has selected that car, all other entries for that car will no longer be eligible to win.  As the Toyota Prius has already been awarded, all entries previously submitted for the Toyota Prius are no longer eligible to win.  Entries for cars already awarded will, however, continue to count for purposes of determining the total number of entries received in the Promotion.  Winners will be determined by random drawing from all eligible entries received during the Promotion Period.  Drawing will be conducted by an independent CPA or company with experience selecting contest winners.  Potential winner must have made a minimum of 10 posts during the Promotion Period in order to be qualified to win.  Winners will be notified by e-mail or regular mail promptly after the drawing.  Winner must respond within 10 days after notification or an alternate winner will be selected.  Winners will be required to complete, sign and return an Affidavit of Eligibility and Liability Release and, where lawful, a Publicity Release no later than 10 days after the date winner responds to the notice that he or she is the winner.  If documents are not returned timely, or if a prize notification or prize is returned as non-deliverable, or if a winner is found to be ineligible or otherwise not in compliance with these Prize Drawing Rules, the applicable prize will be forfeited and an alternate winner selected.  You may win only one car in any 24 month period.

Entrants from Canada and certain other countries selected as a potential winner in any drawing will also be required to correctly answer, without assistance of a calculator or other assistance of any kind, a time-limited mathematical skill-testing question to be administered by telephone.

PRIZES:  Two separate prizes are still available: a Mini Cooper and a Smart Car (2006 model year or newer).  Approximate Retail Value:  Mini Cooper $17,450; Smart  Car  $12, 500.  Prize awarded depends on choice made at the time of entry.  Prizes provided “as-is.”  Prizes will be delivered at a location to be specified in Sponsor’s sole discretion within the continental United States.  Transportation or shipping of the car from the point of delivery, optional equipment, extended warranty coverage, insurance, registration, license fees, fuel and maintenance and taxes are not included in the prize and are the sole responsibility of the winner.  No transfer, cash redemption, or substitution of prize permitted, except Sponsor may substitute cash or prize of equal or greater value if stated prize becomes unavailable or for any other reason in its sole discretion.  All prizes will be awarded.

ODDS:  Odds of winning will depend on the total number of eligible entries received for each prize.

GENERAL CONDITIONS:  You agree (a) that Sponsor, its respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents are released from, will have no liability whatsoever for, and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to person(s), including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Promotion or any Promotion-related activities and (b) except where legally prohibited, winners grant permission to Sponsor and those acting under Sponsor’s authority the right to the use of his/her name, picture, likeness, voice, biographical information and statements, at any time or times, for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval.  Taxes on prize are solely each winner’s responsibility.  Information provided during registration is subject to the Privacy Policy available on the Web Site. 

LIABILITY LIMITATIONS:  Neither Sponsor nor its agencies are responsible for lost, late, misdirected, incomplete, non-delivered entries or email; or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Web Site, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information.  Persons who tamper with or abuse any aspect of this Promotion, as solely determined by the Sponsors, will be disqualified.  Neither Sponsor nor its respective agencies are responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Promotion or downloading materials from or use of the Web Site.  Should any portion of the Promotion be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Promotion, and select the winners from entries received prior to action taken or as otherwise deemed fair and appropriate by the Sponsors.  Neither Sponsor nor its respective agencies are responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion, and assume no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction, or unauthorized access to or use of this Web Site.  Sponsor provides no warranty with respect to the prizes.  Any warranty for a prize shall be as provided by the manufacturer of the prize.

In no event will Sponsor, its affiliates, subsidiaries and related companies, their RESPECTIVE advertising or promotion agencies or ANY OF their respective officers, directors, employees, representatives and agents be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and use of the web site or downloading from and/or printing material downloaded from THE web site.  Without limiting the foregoing, everything on the web site is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, implieD warranties of merchantability, fitness for a particular purpose or non-infringement.  Some jurisdictions may not allow limitations oR exclusion of liability for incidental or consequential damages or exclusion of implied warranties, so some of the above limitations or exclusions may not apply to you.  Check your local laws for any restrictions or limitations regarding these limitations or exclusions. 

GOVERNING LAW & DISPUTES:  All matters relating to the Promotion shall be governed by these Prize Drawing Rules and California law.  Sponsor’s decisions are final and binding in all matters related to this Promotion.  Any disputes will be resolved exclusively by arbitration administered by JAMS pursuant to its Streamlined Arbitration Rules and Procedures, with such arbitration to be held in San Diego, California.  By participating in the Promotion you consent to arbitration in San Diego, California, as the sole and exclusive forum and venue for resolving any disputes arising under these Prize Drawing Rules or in connection with the Promotion and waive all rights, if any, to a trial by jury.  If the foregoing arbitration provision is deemed to be unenforceable for any reason, you consent to the exclusive jurisdiction and venue of the state or federal courts located in San Diego County, California.
